Presenters
Liz Gellert
Liz is a Partner at Lowndes Jordan focusing on commercial litigation and insolvency. She has acted for corporates, insurance companies, banks, and finance companies, and insolvency practitioners. In addition to having extensive experience delivering contentious and strategic legal advice, Liz worked in-house at ASB Bank for nearly four years leading the Disputes and Regulatory Change legal team and later as Acting General Manager of the Legal Services team. She has hands-on practical knowledge of providing legal advice to both in private practice and a corporate environment.
Philip Shackleton
Phil is a lead partner in MC’s Insolvency, Recoveries and Enforcement Group and one of New Zealand’s most innovative and experienced banking, finance and insolvency litigators. He and his team act for both debtors and creditors, including companies and directors facing recovery demands, private insolvency practitioners and the Official Assignee. For 18 years, Phil has had lead roles in some of New Zealand’s most important insolvency cases, including the precedent-setting Debut Homes litigation, the first time the Supreme Court considered the issue of director’s duties. Major clients have included businesses in the construction, hospitality and tourism, dairy, forestry, and residential and commercial property sectors. Phil's particular expertise includes receiverships, liquidations, security enforcement, priority disputes, shareholder disputes, banking litigation and debt recovery.
Lynne Van
Lynne is a general commercial litigator with particular expertise in insolvency, property, securities enforcement, and recoveries. She has appeared as counsel in the Supreme Court, Court of Appeal, High Court and Maori Appellate Court. Lynne successfully acted for the liquidators of Northern Crest, parent company of the Blue Chip group, against Robt Jones Holdings in the leading decision from the Supreme Court on voidable transactions and third party payments. She regularly advises liquidators, receivers, administrators and private clients on a range of complex insolvency related matters including restructuring, breach of directors’ duties claims, voidable transactions and other preference claims.
Leon Bowker
Leon Bowker is a Partner with KPMG New Zealand in the Restructuring team. Leon has over 15 years‘ experience across restructuring, insolvency, transactions services, and dispute resolution, including more than ten years with KPMG Deal Advisory. His work involves helping businesses by providing independent reviews on performance, recovery options, value enhancement strategies, including undertaking insolvency appointments. Leon also supports clients undertaking transactions with due diligence and other financial advisory services.
Russell Fildes
Russell leads the Insolvency and Trustee Service (ITS) which as the Official Assignee administers all bankruptcies, no asset procedures and debt repayment orders in New Zealand. The Official Assignee also gets appointed as liquidator, interim liquidator, administrator of insolvent deceased estates and as receiver under the Insolvency Act 2006 by the Court. Russell has worked in the insolvency industry for over 15 years predominantly with ITS but also with PwC and is a Chartered Accountant.
Ben Francis
Prior to joining Gerry Rea Partners Ben worked in specialist insolvency firms in both Australia and New Zealand. He has worked on a range of corporate insolvency appointments across a range of industries, including Liquidations (both court and voluntary), Receiverships, Voluntary Administrations and Deeds of Company Arrangements. Ben has experience running the trade-on and sale of businesses, as well as comprehensive investigations into company failures and voidable preference recoveries. Ben works primarily on corporate insolvency appointments and is focussed on maximising the return to creditors. Ben has experience working with companies with turnovers ranging from $50,000 a year to $30,000,000 per year. Outside of work Ben enjoys travelling with his family and is a passionate follower of many sports and is actively involved in rugby union as a rugby referee.
Nick Hale
Nick has 20 years banking and finance experience covering loan structuring, relationship management, credit and restructuring experience. In his role he manages a team that attempts to assist larger business borrowers in financial difficulty to return to viability or, where this is not possible, to maximise the bank’s recovery.
