Critical Family Law Updates and Intersection with Other Law

9.00am to 10.00am: “Changes – Turn and Face the Strange”: Facing the Law Commission’s Recommendations Regarding Relationship Property
The Law Commission has delivered its preferred approach to the treatment of relationship property issues after its review of the Property (Relationships) Act. Considering how previous cases may have been decided differently if the recommended approach were applied, this session will explore what this may mean for relationship property clients and practitioners if we are faced with implementation of the recommendations.
- Will clients be better or worse off under the proposed Family Income Sharing Arrangements (FISAS)? What are the fishhooks with FISAs?
- What processes will be used to resolve relationship property matters and will these afford clients a more efficient and effective resolution?
- How will disclosure be treated under the preferred approach?
- What will be the impact upon children’s interests?
- What will the impact be of broadening section 44C?
