- Examine the relevant issues and considerations in determining when a finding of contributory negligence is open in WorkCover common law claims, with particular reference to the recent Court of Appeal case of Aycicek v Flowline Industries Pty Ltd [2019] VSCA 37
- Examine:
- the employers duty to establish, maintain and enforce a safe system of work
- reduction of damages on the basis of contributory negligence where the worker failed to take reasonable care for their own safety
- If the worker’s conduct was no more than mere inadvertence, inattention or misjudgement, a finding of contributory negligence will not be open
