3.45pm to 4.30pm Trust Structuring in Conveyancing Transactions
Consider the commonly used trust structures in residential and commercial conveyancing transactions. Trusts are often set up for “tax, asset protection and succession planning purposes”. However, there is no one size fits all when advising clients.
Gain a greater understanding of the issues that may be relevant in deciding whether to acquire property in a trust (rather than as an individual or through a company) and some practical suggestions on how to assist clients with setting up and managing a trust.

Joan Lentini
Joan Lentini is the immediate Past President of the Australian Institute of Conveyancers Victoria. Joan has given many hours to various stakeholder and specialist working groups for the advancement of conveyancers in Victoria including the Victorian State Revenue Office and PEXA. Joan manages her own successful conveyancing business in Port Melbourne and is highly qualified with over 40 years’ experience in all facets of conveyancing.
Todd Allen
Todd Allen has a broad commercial law practice with particular expertise in building, construction and property. He accepts briefs in most areas of commercial litigation including general commercial, consumer law, intellectual property, corporations’ law, insolvency and ADR. Prior to coming to the Bar, Todd was Principal and Director of Axiom Legal Pty Ltd, a law firm with offices in both Melbourne and Perth. At Axiom, Todd predominantly advised the ABN Group, one of Australia’s largest home building groups. Todd advised the ABN Group’s residential construction, commercial construction, land development and fund lending businesses. Todd is particularly well placed to advise on matters relating to greenfield development and construction in Victoria.
Alex Kuraica
Alex is a senior associate in the Disputes and Investigations team at Colin Biggers & Paisley. Alex has a broad practice in commercial and disputes resolution, corporate and estates litigation, equity and trusts disputes, and insurance litigated disputes. Alex acts on behalf of corporations, high-net-worth individuals, partnerships, investment schemes and businesses across a wide variety of industries and in respect of a broad spectrum of litigated matters, including corporate disputes, contractual disputes, oppression proceedings, claims arising out of the breach of the Consumer Law, Corporations Act or in respect of a contravention of the ASIC Act, commercial leasing disputes, insolvency related matters, professional insurance litigation, and general commercial litigation.
Winnie Wong
Winnie practices in commercial and administrative law, specialising in taxation. Before coming to the Bar, Winnie was a Senior Associate in Clayton Utz’s taxation practice and has advised on various federal and state tax disputes. She has advised on a number of complex income tax issues involving individual and corporate tax residency, application of double tax treaties, capital gains tax (CGT) rules for individuals, trusts and companies, application of Division 7A and the general anti-avoidance rules. She has also advised on goods and services tax (GST), stamp duty, payroll tax, the research and development tax incentive (R&D), customs and superannuation regulatory matters.
Nathan Papson
Nathan Papson is Papson Legal's principal lawyer, with experience in the fields of SMSF law, taxation law, estate planning and commercial law. During his career he has worked in the taxation division of a Big 4 accounting firm as well as a number of prominent SMSF legal practices. His qualifications include a Master of Laws from the University of Melbourne (focussed on taxation), as well as industry qualifications of Chartered Tax Adviser (by The Taxation Institute) and SMSF Specialist Adviser (by the SMSF Association - a leading industry group on SMSFs). This combination of qualifications is among the highest attainable in the areas of SMSF and taxation law.
