Anita Wear
Anita has over 18 years’ experience in a broad range of insurance coverage, advice and defence work. Anita specialises in financial lines insurance with a particular focus on directors & officers insurance, investment management and professional indemnity insurance for professionals in the financial sector. Anita has acted for major insurers in coverage disputes and more generally advising on litigation, as well as mediated solutions. Beginning her career as an insurance lawyer in New Zealand, Anita re-located to Australia where she has been a member of HWL Ebsworth's insurance group since 2011. Anita's focus is on Australian-based clients to find practical solutions across the full range of challenges and opportunities that present in the insurance sector.
Anita’s experience includes advising:
- Insurers in large directors and officers claims and resulting litigation, achieving negotiated settlements at mediation and before;
- Defence of Directors and other professionals in litigated claims and regulatory prosecutions;
- Various clients on Insurance and reinsurance claims monitoring and coverage advice including claims involving large-scale excess of loss financial lines and class-actions;
- Life Insurers in relation to complex litigation involving claims for Total and Permanent Disablement benefits and Income Protection/Salary Continuance cover alleging physical and/or psychological injury; and
- Various insurers on complex claims assessments, advice on policy wordings and the review of policy terms in the context of the unfair contract terms regime, and preparation of substantive responses to ASIC notices and thematic reviews.
