The Western Australian Government has announced a suite of land tenure reforms headlined by a new form of tenure – the diversification lease. The new lease will provide a form of tenure that can support the establishment of clean energy projects and the expansion of carbon farming in Western Australia. In anticipation of the ‘Land and Public Works Legislation Amendment Bill 2022’ being introduced into Parliament later this year, the session will provide an overview of the proposed reforms. This timely analysis of the new reforms will examine:
- What a diversification lease is and their potential benefit for clean energy, such as hydrogen, wind and solar, and carbon farming projects
- How the reforms are positioned to:
- Diversify the Western Australian economy
- Provide an opportunity for pastoralists, native title parties and others to get involved in the growing renewables market
- Support Western Australia reaching its climate change and ESG goals
- Timeline for the reforms being introduced into Parliament and passed into law

Christopher Marchesi
Chris is a special counsel in Gilbert + Tobin's Energy + Resources group in Perth, specialising in mining, oil & gas, renewables and infrastructure projects and M&A. Chris advises Australian and international energy and resources companies, project owners and investors across a wide range of project development matters and transactions in the energy and resources industry. Chris’ work spans project development, land access, environment, clean energy, State Agreements, offtake and energy supply (including LNG and gas), acquisitions, disposals, financings, joint ventures, approvals and regulatory matters. Chris has a Bachelor of Laws and a Bachelor of Commerce (Finance) from the University of Notre Dame Australia.
Claire Boyd
Claire is a partner in Gilbert + Tobin's Energy + Resources group. Her expertise spans all aspects of resources projects from acquisition, structuring, financing and implementation to the on-going development, operation and then divestment of projects. As well as negotiating and documenting transactions, Claire provides advice on regulatory compliance and approvals, and tenure land access matters. Claire has considerable multi-jurisdictional experience, having advised on projects in all states and territories of Australia as well as overseas in countries including Turkey, the Philippines, Fiji, Vanuatu, Pakistan and various African countries. Claire has a Bachelor of Laws and a Bachelor of Science from the University of Western Australia. She also has a Graduate Diploma in Applied Finance and Investment from the Financial Services Institute of Australia.
