An awareness of the key issues for determining the ‘consideration’ for a transaction is critical for any property lawyer or conveyancer to ensure that structuring alternatives are not overlooked and that a client’s expectation in terms of the amount of duty payable on a transaction is managed. You will consider how the ‘consideration’ for a transaction is determined in various scenarios (including recent cases) with reference to:

Kelly Young
Kelly Young is a fully unrestricted Conveyancing Licence holder and sole director of Estate Conveyancing, located in Macleod. Kelly and her staff at Estate Conveyancing prides themselves and providing education to clients and referrers alike. Kelly has been working in the legal industry for 20 years with experience in the property fields of settlements, conveyancing and residential and commercial lending. Starting out as a junior paralegal in stamping, registration and settlements, moving onto residential mortgages, Conveyancing and also Commercial Lending, Kelly has a background working in accountant firms, law firms and conveyancing offices in Melbourne city, rural areas of Victoria and in England. Kelly is a committee member of the Australian Institute of Conveyancers VIC Division.
Tim Graham
Tim joined the partnership of Bugden Allen Graham Lawyers in June 2021, his name being added to the firm’s brand. Tim is one of Australia’s pre-eminent strata lawyers and is internationally renowned. He is President of the Australian College of Strata Lawyers (ACSL) and a Fellow of the College. Tim is also a Council Member of Strata Community Australia (National) and Strata Community Australia (Victoria). He sits on the Property Law Committee of the Law Institute of Victoria. Tim has been recognised by his peers and numerous local and international awards including Best Lawyers® in Australia six (6) times, and in the Doyle’s Guide as a Leading Property and Real Estate Lawyer and Leading Litigation & Dispute Resolution Lawyer.
John K Arthur
John is a barrister at the Victorian Bar of over 30 years standing. An experienced advocate, his principal area of practice is general commercial litigation, including contract, sale of land, property, equity, professional negligence, corporations, insolvency, and succession. His particular focus are trials and appeals. He is a Fellow of the Chartered Institute of Arbitrators (CIArb) and ACICA and a National Councillor of CIArb and its President and a member of the National Executive Committee of the Asian Australian Lawyers Association. John has published and presented many papers in Australia as well as internationally on topics in varied areas of law and practice, including contract, sale of land, equity, practice and procedure, ADR and international arbitration. He is a co-author of Lexis publications, Civil Procedure Victoria, Lexis Nexis and Australian Uniform Evidence. He also contributes to other publications.
Nathan Papson
Nathan Papson is Papson Legal's principal lawyer, with experience in the fields of SMSF law, taxation law, estate planning and commercial law. During his career he has worked in the taxation division of a Big 4 accounting firm as well as a number of prominent SMSF legal practices. His qualifications include a Master of Laws from the University of Melbourne (focussed on taxation), as well as industry qualifications of Chartered Tax Adviser (by The Taxation Institute) and SMSF Specialist Adviser (by the SMSF Association - a leading industry group on SMSFs). This combination of qualifications is among the highest attainable in the areas of SMSF and taxation law. Nathan has given presentations on superannuation and taxation for CPA Australia, the SMSF Association, the Melbourne Business School and to various discussion groups and forums.
Rosalie Cattermole
Rosalie Cattermole is Special Counsel at Arnold Bloch Liebler. Rosalie specialises in indirect taxes with a particular focus on duty and land tax Australia wide. She has considerable experience in dealing with the state/territory revenue offices’ Australia wide including private ruling applications, complex lodgements and objections. Rosalie has advised extensively on the duty implications of asset and share sale and purchase agreements, corporate reconstructions, transactions involving trusts and partnerships, and the application of the various surcharge duty and land tax regimes that operate across Australia. Rosalie has a diverse client base including listed entities (particular in the property development, and energy & resources sectors), government owned corporations, private groups and high‑net‑worth individuals.
Greg Cooper
Greg Cooper is a Business Development Manager with Stewart Title Limited. Greg is responsible for advising lawyers, conveyancers and their clients about the coverage and benefits provided by a title insurance policy.
Tom Champion
Tom has a broad range of experience in complex building subdivisions, engineering surveying and consulting on issues relating to land status and development. His experience and expertise provides invaluable assistance to the consultants and construction teams throughout the various stages of the project. Tom is responsible for managing the expectations of clients and providing them with professional advice. He also instructs survey staff in project matters and regularly deals and consults with Council, Service Authorities, Government Departments and Project Stakeholders.

David McKenzie
David McKenzie has thirteen plus years of PQE and has spent the vast majority of that time practising in the area of property law. Specifically, David has completed transactions in the following areas: Subdivisions (both tower and green field); Planning issues related to subdivision; Section 173 agreements and the issues related to those agreements; MCPs both drafting and registering; Covenant drafting and removal; Law of easements; Owners Corporations; Leasing (Retail and Commercial).
Anastasia Aslanidis
Anastasia Aslanidis is Principal Director at Bedelis Laywers. Anastasia is an accredited property law specialist. Anastasia has acted for landlords, tenants, major banks, government bodies, corporations, charitable organisations and SMEs.
