An appropriately constructed estate plan should have regard to the full circumstances of the client, not only their assets and how they are held, but also to their family dynamic and the potential for disputes.

The Holistic Estate Plan: Taking Instructions, Anticipating Disputes and Managing the ‘What If’s”
You will work together with the workshop facilitators to further develop practical skills in the following areas:
Taking effective instructions and anticipating family disputes
- Giving the client what they need, not what they think they want
- Managing the ‘human factor’
Using the ‘what if’ approach to will drafting
- Drafting hotchpot clauses that actually work
- Managing unintended tax consequences
Succession planning for related entities and the intersection with the estate plan
- Positions of conflict post Brine v Carter
- Identifying and managing issues in existing structures which obstruct the estate plan
